Officials with the Federal Motor Carrier Safety Administration (FMCSA) recently unveiled new findings from a third-party, real-work study to help get a closer look into the hours-of-service regulations and their success.

“This new study shows more data-driven evidence that our safety standards help truckers stay well-rested, alert and focused on the road,” said U.S. Transportation Secretary Anthony Foxx.

Our Delray Beach car accident lawyers know truck accidents kill over 5,000 people and injure almost 150,000 motorists on our nation’s roads and highways each year. When commercial drivers become fatigued from excessive daily and weekly work hours, they substantially increase the risk of crashes that result in death or serious injuries. In the recent FMCSA study, researchers looked into sleepiness, reaction time, sleep habits and driving performance. The study concluded that drivers who start their work week with just one nighttime period of rest display more lapses in judgment behind the wheel, especially during the evening and early-morning hours. They also found that these drivers reported more sleepiness and increased lane deviation.

Bicyclist and pedestrian safety are among eight emphasis areas in Florida’s 2012 Strategic Highway Safety Plan (SHSP). The SHSP has identified six strategies on which to focus safety efforts.

In the detailed Florida Pedestrian and Bicycle Strategic Safety Plan, officials are working to provide a comprehensive framework to reduce the risks of injuries and fatalities among bicyclists and pedestrians along our busy public roads. Key areas in this plan are focusing on aggressive driving habits, intersection accidents, vulnerable road users, lane-departure accidents and looking closely into traffic information throughout the state.

In 2011, the state’s pedestrian fatality fate was close to double the nation’s average and bicycle deaths were close to triple the national average. According to the National highway Traffic Safety Administration (NHTSA), the Sunshine State had the highest fatality rates among all states in 2011 for pedestrian fatalities, at close to 3 per 100,000 people. Even though the fatality rate decline a little bit from 2010 to 2011, our bicycle fatality rate increased from about .40 fatalities per 100,00 people to about .63 — a jump of about 50 percent.

Our personal injury attorneys in Coral Springs understand that Florida only accounted for about 11 percent of the nation’s population in 2011, but we accounted for more than 17 percent of all bicycle fatalities in the nation that year. The “Dangerous By Design” report shows us that the top four metropolitan areas on the list for areas most dangerous for pedestrians were all in the state of Florida, including Orlando-Kissimmee, Tampa-St. Petersburg-Clearwater, Jacksonville and Miami-Fort Lauderdale-Pompano Beach. Miami-Dade County was ranked as the most dangerous for pedestrian fatalities and injuries from 2007 to 2011.

Car seats could soon for the very first time be required to protect children from injury and death in side-impact accidents under new regulations proposed by the government.

According to the Los Angeles Times, officials with the National Highway Traffic Safety Administration (NHTSA) recently upgraded standards for car seats that are used to protect children who weigh up to 40 pounds. The update included a new test that simulated a side-impact accident. Officials estimate that these new standards could help to prevent about five fatalities and more than 60 injuries each year. If all parents properly used the seats, hundreds of lives could be saved and thousands of injuries prevented.

“Car seats are an essential tool for keeping young children safe in vehicles, and they have a proven track record of saving lives,” David Friedman, NHTSA Acting Administrator.

Our child injury lawyers in Margate note the new test would reenact a “t-bone” accident, in which the front of a vehicle traveling at 30 miles per hour would hit the side of a small-passenger vehicle traveling at 15 miles per hour. According to recent NHTSA research, these kinds of accidents cover about 90 percent of the side-impact accidents we see each day. According to studies, many child injuries and deaths in side-impact accidents involve a vehicle stopped at an intersection, usually at a stop sign or a red light. When the car begins to move forward, it’s oftentimes hit in the side by a vehicle that’s traveling faster on the cross street.

State and federal traffic laws and regulations are intended to keep drivers and other motorists safe. Issuing citations is one way to enforce seat belt laws, speeding limits, and other traffic regulations. What if a law goes unenforced? Is it still effective? Do drivers and motorists still see the benefits of the law? According to recent reports, Florida’s texting while driving laws have essentially gone unenforced throughout Broward County. The law went into effect in October, however there were only 32 citations issued in Broward County through the end of December.

This is a serious hazard and an epidemic that continues to pose a significant risk to drivers and other motorists on the road.

The next time you’re driving down the road and encounter an emergency response vehicle or an officer on the side of the road, you may want to pay a little better attention. Officials with the Florida Department of Highway Safety and Motor Vehicles (DHSMV) recently announced the launch of a new enforcement effort aimed at drivers who don’t obey the state’s Move Over law.

Throughout January, officials with the Florida Highway Patrol (FHP) and other law enforcement agencies throughout the state will be on the hunt for drivers who crowd these roadside workers, putting everyone’s safety at risk. Troopers will be raising awareness and increasing patrols to make sure that everyone is aware of the state’s law.

Our West Palm Beach car accident lawyers know the Move Over Law is designed to protect Florida police, fire, and other emergency workers when they are on roads and highways. As you approach emergency vehicles you must move out of the lane closest to them if the road has two or more lanes traveling in your direction. Unfortunately, there are not many drivers who are paying attention and who are blatantly disregarding this law.

Two men were recently killed in a Coral Springs traffic collision in which police say the driver rounded a curve, lost control of the vehicle and slammed into a tree.
Both men, aged 22, are believed to have died upon impact. While the investigation is ongoing, authorities are speculating that speed was most likely a factor in the wreck.

The National Highway Traffic Safety Administration reports that one-third of all traffic deaths each year are the direct result of a driver who was traveling too fast. That amounts to about 10,000 lives lost.

From regulating the backseat bickering to glancing back to check on the strapped-in infant, parents are among the most distracted drivers on the road.

This is not especially surprising, particularly for those who are parents. However, the degree to which they are distracted is startling. A new study by Australian AAA researchers suggests parents are 12 times more distracted than drivers who talk on their cell phones!

Over a period of three weeks, the scientists monitored the car trips of 12 families via in-car cameras. On average, the families each had two children who were between the ages of 1 and 8.
